USER AGREEMENT

1. PARTIES

1.1. This User Agreement (hereinafter referred to as the “Agreement”) is concluded and maintained in accordance with the laws of the Republic of Turkey between Monami Kozmetik Pazarlama ve Ticaret Anonim Şirketi (“Monami Kozmetik”), located at Esentepe Mahallesi, Kardeşler Sokak, Öztürk Apt. No:14, Şişli, Istanbul, and the User accessing the website miaklinika.com (hereinafter referred to as the “Website”).This Agreement governs the User’s access to and use of the Website and is deemed to have been accepted electronically by the User upon approval within the Website environment.

1.2. By logging into and/or using the Website, the User acknowledges, declares, and undertakes that they have read the entire Agreement, fully understood its contents, and agree to all its terms and conditions.

(Monami Kozmetik and the User shall hereinafter be collectively referred to as the “Parties.”)

2. SUBJECT AND SCOPE OF THE AGREEMENT

2.1. This Agreement sets forth the mutual rights and obligations of Monami Kozmetik and the User regarding the services (“Service”) provided through the Website. Users cannot proceed with purchasing products or services without reading and accepting both the User Agreement and the Privacy Policy.

2.2. By checking the box stating “I have read and accept the User Agreement and Privacy Policy” during the purchasing process, the User agrees and declares that the personal and transactional information they provide may be used by Monami Kozmetik to deliver the Services offered on the Website.

3. TERMS OF SERVICE

3.1. Any individual wishing to purchase products through the Website must provide the required information and meet the conditions specified in this Agreement to gain User status.
Persons under the age of 18, minors, legally restricted individuals, or those lacking legal capacity may only conduct transactions through their parents or legal representatives. Otherwise, all transactions made shall be deemed invalid.

3.2.The Website may only be visited, viewed, and used to make transactions or purchase products for lawful, personal, and non-commercial purposes. Any use beyond these purposes is strictly prohibited.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. Rights and Obligations of Monami Kozmetik

4.1.1. Monami Kozmetik reserves the right to unilaterally modify this Agreement, in whole or in part, at its sole discretion, without prior notice and without providing any reason. Such amendments shall become effective upon publication on the Website and shall be binding on all Parties. Continued use of the Website and its Services by the User after any such modification constitutes acceptance of the revised terms.

4.1.2. Monami Kozmetik reserves the right, without prior notice, to modify, suspend, limit, or terminate any part of the Services or the Website, including restricting access to or deleting any content or data uploaded by Users or third parties. Monami Kozmetik may exercise this right at any time, without prior notice, and bears no liability for any losses or damages that may arise from such actions, provided that there is no legal obligation to the contrary.

4.1.3. Any changes in prices or product details are made at the discretion of Monami Kozmetik in accordance with applicable laws and regulations.

4.1.4. Monami Kozmetik is not responsible for verifying the accuracy, reliability, or legality of information and content provided or uploaded by Users on the Website. Users are solely responsible for the accuracy and legality of such information and content. Monami Kozmetik shall not be held liable for any damages resulting from inaccurate, unlawful, or misleading information or content.

4.1.5. Links to third-party websites, files, or other content provided through the Website are for informational or advertising purposes only. Monami Kozmetik does not guarantee the safety, accuracy, or legal compliance of such third-party content. The responsibility for the accuracy, legality, and compliance of information, visuals, and audio materials provided by third parties lies solely with those parties.

4.1.6. Monami Kozmetik does not guarantee that the Website or files downloaded from it are free from viruses or other harmful components, or that the Website will be uninterrupted or error-free.
It also does not guarantee any specific results from the use of the Website or its Services. Monami Kozmetik shall not be held liable for any direct or indirect damages, losses, or disruptions resulting from force majeure events, third-party actions, user conduct, or other circumstances beyond its reasonable control.
